Child support from someone who did not sign the recognition of parentage?

What is the name of your state (only U.S. law)? California The man I was with (Steve) while pregnant to my daughter signed the paternity papers and the birth certificate at time of birth but has been out of the picture for 5 years. The possible real father (Josh) wants to get a paternity test done. He also has not been in the picture for 5 years. If It came out that he (josh) was the father, what kind of rights would he have. Would he have to pay back child support or any child support that (Steve) owes, even know Steve was the one that signed the paternity papers. Would he have any financial obligation?

  1. wont happen, i'm afraid you will have to get a court ordered paternity test first.
  2. in my opinion, if Josh is the real father, then he has to sign the paternity papers and start paying child support since that time, if steve is the real father, then he will end up owing you five years of child support.
