Marriage in the US with a UK Gender Recognition Certificate?

Would a pre-op MtF UK national with a Gender Recognition Certificate be legally allowed to marry a male US citizen, in the US?

  1. Yes, once you have the gender certificate then in the eyes of the law you are that gender and can marry.
  2. A gender recognition certificate issued in the UK likely means nothing in the US. If you’re pre-op, you’re still technically and legally a male (just as stated on your birth certificate). Possibly you can marry another male in a state that allows gay marriage. Of course, then you have to consider the issue of…once you're technically and legally a female, will your gay marriage still be recognized. You need to talk a US attorney who specializes in these issues. I doubt you will be able to find your answer here at YA.
